There is no one best phone, the best at the moment are: Nexus 4, Galaxy S3, Note 2 and the Droid DNA.

Depends, if you want a pure Android experience with no custom UI and/or alot of bloatware, the Nexus phones are your best bet (especially the latest, the LG Nexus 4). If anyting else, the Galaxy S3, Note 2, HTC One X+ or any other high-end Android phones does their job.
